TERMS OF SERVICE
Summary of TermsArtist: The artist refers to the commissionee (Cygni Aster). They are the person who will be delivering the artwork.Commissioner: The commissioner refers to the individual/body/entity that is in communication with the artist to request the commission.Commission: The commission is the product in question that is to be delivered and agreed upon by both the artist and commissioner. This is in the form of the artwork requested by the commissioner in line with the agreed style by both parties.
General TermsThe artist reserves the right to use all commissioned artwork, sketches and drafts on their portfolio and social media platforms. The Commissioner may request to remain anonymous but the artwork will still be used in the Artist’s/Commissionee’s portfolio.
Should the need for a Non-disclosure Agreement (NDA) arise in which the commissioner requires a complete NDA, the artist would need to review the agreement and add additional fees to cover the NDA.
Credits or gratuities are appreciated but not required.
The Artist/Commissionee reserves the right to reject any order that makes them uncomfortable for any reason or outside the agreed scope of their abilities.
UsageThe commissioner is allowed to use the commission for personal and commercial use.
The commissioner cannot claim the artwork as their own.
The commissioner can alter the artwork but cannot claim the artwork as their own after any alterations.
Graphics/Artwork used in the commission process cannot be utilized by the commissioner until full payment has been received and confirmed by the Artist/Commissionee.
PaymentA payment is required in order for the commission process to start. Payments can be done as follows:
* Full upfront payment
* 50% upfront down payment, 50% upon sketch approval
Staggered payments must be first communicated and agreed upon by the artist and the commissioner.
Payments should not be sent unless specifically agreed and requested by the artist.
Process and DeliveryThe commissioner will be notified once the commission has started. Payments will no longer be refundable when the sketch has been delivered.
The commissioner reserves the right to request updates from the artist in a timely manner.
The delivery period for commissions varies from 1 week to 2 months depending on factors that need to be communicated by the artist. Any delays need to be communicated by the artist to the commissioner.
The commission/artwork will be delivered in full resolution with the agreed upon file formats.
The commissioner may request commission in different file formats subject to the approval of the artist.
RevisionsMinor revisions are free and included in the price. Major revisions or edits that involve significant alteration of artwork need to be reviewed and agreed upon by the artist and may cost an additional fee.
Any major revisions to the artwork after the sketch is agreed upon and finalized will also need to be reviewed and agreed upon by the artist and may cost an additional fee.
Proceeding to contact the artist and requesting the commission means that you have agreed to their Terms of Service.
